Terms of Use

The agreement between you and Econa when you use the Wellbeing Check, the Labs, or this site.

Econa does not provide medical care, and nothing here is a substitute for it. The Entrepreneur Wellbeing Check is a screening instrument, not a diagnostic tool, and it cannot tell you whether you have a condition.

1Accepting these terms

These terms are an agreement between you and Econa. By using founderscreen.org or econa.net, taking the Entrepreneur Wellbeing Check, using an Econa Lab or joining the Econa Village, you accept them. If you do not accept them, please do not use the services.

Econa's services are available internationally. You are responsible for complying with the laws that apply where you are.

The trauma screener

The Trauma Lab uses the EPC-PTSD-5, an Econa adaptation. In Dr. Freeman's words: “The items are evidence-based. The instrument has not been validated and also there is no existing validated instrument to detect PTSD among entrepreneurs.” The life-event and symptom questions are drawn from the widely validated PC-PTSD-5. Treat any result from it as a prompt to speak to a licensed clinician, and nothing more.

6Intellectual property

What is yours to use freely

The Entrepreneur Wellbeing Check instrument is in the public domain. It is not proprietary. It was placed in the public domain deliberately, so that anyone may use it and its reach is not limited by who can pay. You do not need our permission to use it.

What remains Econa's

The Econa Labs and their content, the site, the software, the FounderScreen and Econa names and marks, and the design of this site are owned by Econa or its licensors. You get a limited, personal, non-transferable, revocable license to use them for their intended purpose. That license does not let you copy, adapt, redistribute or build a competing service from them.

What you send us

You keep ownership of anything you submit. You give Econa a license to use it to operate and improve the services, and — only where you have separately agreed — to include de-identified data in research.

Some things are run by other organizations: payment processing, and Connected Mind where you are referred for clinical assessment. Their own terms and privacy policies govern what they do. We choose partners carefully, but we are not responsible for their services or for the content of any site we link to.

Links to crisis and treatment resources are given as a public good. Econa does not endorse, employ or supervise the organizations behind them, and does not receive payment for listing them.

9Disclaimers

The services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that any result will be accurate for your particular circumstances.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is so, the exclusions above apply only as far as the law permits, and your statutory rights are unaffected.

10Limitation of liability

To the fullest extent the law allows, Econa and its officers, employees, faculty and contributors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the services.

Our total aggregate liability arising out of these terms is limited to the greater of the amount you paid Econa in the twelve months before the claim, or one hundred US dollars.

Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, for fraud, or for any right you hold as a consumer under mandatory local law.

11Indemnification

You agree to indemnify Econa against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the services, or your violation of any law or of anyone else's rights. This does not apply to the extent a claim arises from Econa's own act or omission.

12Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

If something goes wrong, tell us first. Most problems are solved that way, and we would rather fix it than argue about it. If we cannot resolve it within 60 days, the dispute will be settled by binding arbitration on an individual basis, and not as a class action, in California or by remote hearing.

This clause yields to your local law. If you are a consumer in the UK, the EU or the EEA — or anywhere else whose mandatory rules give you the right to bring proceedings in your own courts or to opt out of arbitration — those rights apply and this section does not take them away.

13Changes and termination

We may update these terms. The effective date at the top will change, and we will flag significant changes prominently. Continuing to use the services after a change means you accept the updated terms.

We may modify, suspend or discontinue any part of the services. You may stop using them at any time. The sections on intellectual property, disclaimers, liability, indemnification and disputes survive the end of this agreement.

If any provision is held unenforceable, the rest stays in force.
